The General Terms and Conditions of the www.bungee.si website (hereinafter: Terms and Conditions) determine the basic conditions for the use of the www.bungee.si website and the order and purchase of gift vouchers. By entering the website or ordering a gift voucher, the user confirms that they have read these Terms and Conditions, and that they agree and accept them in their entirety. The Terms and Conditions are published on www.bungee.si.

These Terms and Conditions determine the order and purchase conditions of gift vouchers on the www.bungee.si website. The user may place a gift voucher order on the website 24 h/day in the Slovene, Italian, or English language. TOP GO d.o.o. reserves the right to change the Terms and Conditions at any time, in any manner, and for any reason without notifying its users beforehand. The gift voucher buyer is bound by the General Terms and Conditions in effect at the time of purchase. The buyer is explicitly reminded of this when placing the order. By placing an order, the user confirms that they have read the Terms and Conditions, and that they agree and accept them in their entirety.
PURCHASE – ORDERING A GIFT VOUCHER
The user may order a gift voucher in the “Gift voucher” tab by filling in the “Gift voucher order” form. The user selects the desired gift voucher (bungee jumping or bungee jumping + 300 m zip line), fills in the required fields (name and surname, address, e-mail, phone) and enters any additional wishes or comments in the “Notes” field. Your personal data is required by TOP GO d.o.o. strictly for processing gift voucher orders. After having correctly entered the requested data, the user clicks on the “Submit” button to place the order. The user vouches for the veracity and accuracy of the submitted personal data. Once the order is placed, the user will receive an automated e-mail with payment instructions. Upon receipt of payment, TOP GO d.o.o. sends the gift voucher by post to the address the user entered in the online form or to a different address, which the user specified by e-mail. TOP GO d.o.o. shall send the gift voucher on the same or following working day by priority post to Slovenia or Italy, or by e-mail to other countries.
GIFT VOUCHER VALIDITY
A gift voucher is valid for a period of two years from the day of purchase. The expiry date is stated on the back side of the voucher. It is still possible to redeem the voucher within a year post expiry with a surcharge. The surcharge price for an expired voucher can be found on the price list in the “Information” tab. Copying, reproducing, or counterfeiting is strictly prohibited and represents an offence, punishable under current criminal legislation of the Republic of Slovenia. TOP GO d.o.o. shall report all abovementioned offences to the competent national authorities. The offender shall be held fully accountable.
GIFT VOUCHER TYPES
Two types of vouchers may be purchased on the www.bungee.si website:
GIFT VOUCHER REDEMPTION
The user redeems the gift voucher for bungee jumping with TOP GO d.o.o. on the bridge in Solkan, and the gift voucher for zip lining with the Soča Fun Park adrenaline park. The gift voucher must be presented to the staff on the bridge in Solkan; this includes the zip line voucher. The user shall then receive a coupon, which they must hand over at reception of the Soča Fun Park (adrenaline park).
PRICING
Gift voucher prices are in Euros and include VAT. When placing the order, the prices, published at the time of purchase, are deemed valid.
PAYMENT TERMS
The user must pay for the gift voucher via bank transfer to TOP GO d.o.o.’s account within one week of placing the order. Should the user wish to extend the payment deadline, they must inform TOP GO d.o.o. beforehand. Upon receiving the buyer's payment, TOP GO d.o.o. shall issue an invoice and send it by post together with the gift voucher.
RIGHT OF WITHDRAWAL
The user, as a consumer, is protected under the Consumer Protection Act (ZVPot) and it is within their right to withdraw from the contract without justification within 14 days of its conclusion or receipt of the gift voucher by notifying TOP GO d.o.o. The user must return the voucher, together with a copy of the invoice and transactional account number by post to the TOP GO d.o.o. address. Postage is covered by the user. TOP GO d.o.o. shall reimburse the user to their bank account without undue delay and no later than within 14 days after the receipt of the voucher.
RIGHT TO EXCHANGE A SPECIFIC SERVICE/ACTIVITY VOUCHER
Gift vouchers that have a specific activity or service stated on them cannot be exchanged.
The entering of personal data when placing a gift voucher order is necessary for the correct completion of an online purchase. Should the user not wish to disclose personal information necessary for the gift voucher purchase, the order shall not be fulfilled. Personal data that is voluntarily provided by the user for the use of the website is processed on the grounds of legitimate interest of TOP GO d.o.o., also to provide user support and to ensure effective communication.
TOP GO d.o.o. shall store the following buyer personal data for a period of 5 years after the conclusion of the contract and 10 years for tax purposes: name and surname, billing and shipping address, city, country, e-mail for the sending of gift vouchers, contact phone number, past orders, content of the order, and communication archive with TOP GO d.o.o. The gift voucher buyer explicitly agrees with the collection, processing, and use of their personal data. TOP GO d.o.o. shall handle all personal data with confidentiality, in accordance with current legislation. TOP GO d.o.o., the owner and administrator of the www.bungee.si website, uses appropriate software and provides all necessary technological and organisational solutions to ensure complete safety of the order/purchase. TOP GO d.o.o., the data collection manager, is responsible for the protection of personal data and shall use the personal data for the purposes of sending gift vouchers, invoicing, and all other communication (by post, e-mail, and phone), related to the gift voucher ordering services. The personal data of the user or gift voucher buyer shall not be transmitted to a third party or unauthorised person under any circumstances. The user has the right to the access, amendment, and restriction of personal data (to some extent), and data portability. The user may exercise this right by writing to info@bungee.si. An appeal against the data collection manager in terms of personal data protection may be lodged with the Information Commissioner of the Republic of Slovenia.
TOP GO d.o.o. shall not be held liable for potential disruption to the functioning of the www.bungee.si website, which may occur due to various reasons. TOP GO d.o.o. is committed to providing accurate and up-to-date information on its website.
TOP GO d.o.o. is liable for the damage on the gift voucher only to the point of handover to the postal services provider. TOP GO d.o.o. is not liable for the loss of the gift voucher after it has been delivered to the user’s address. The user is not entitled to reimbursement in case of loss of the gift voucher by the user. Should it be discovered that the gift voucher was lost in transit (by the postal services provider), TOP GO d.o.o. shall send the user a copy of the voucher.
TOP GO d.o.o. complies with current legislation on consumer protection and runs an effective system for handling complaints. In accordance with the third paragraph of Article 32 of the Out-of-Court Settlement of Consumer Disputes Act (Official Gazette of the Republic of Slovenia No 81/2015), TOP GO d.o.o. states that it does not recognise any out-of-court settlement of consumer disputes body as competent to settle consumer disputes which would arise due to the operation, use, and purchase conditions on this website. The user may resolve any e-commerce disputes via the Online Dispute Resolution.
TOP GO d.o.o. reserves the right to amend these Terms and Conditions at any time. The amendments come into effect on the day of publication; the users are advised to revisit them regularly. These Terms and Conditions remain valid for all upgrades, new versions, or any other changes made to the website.
